The TM issue is hazy. It's Cisco's mark, licensed to Apple (I think that's how it worked out). Anyway, Apple definitely marketed the product before they had Cisco's approval, which means their own lawyers were asleep at the wheel.
The fact that it's in Arabic convolutes it further, but if you have anything iPhone-related on the site, I would think it's as good as handing it over.
If you turned it into a site dedicated to something else (say, VOIP or a skype-like service), I would think you'd have an argument. Still though, visitors going to find an iPhone would immediately leave the moment they saw that the site was something else.
