Actually, no. The teaching of Darwinian evolution is legal in all 50 states. Furthermore, the religious fundamentalists have not succeeded (yet) in having "Intelligent Design" (the latest incarnation of Creationism) taught in any public school.

This is especially remarkable given that, according to today's Financial Times, 45% of Americans believe that humans were created by God less than 10,000 years ago.
