I think I would start filing lawsuits in the event anyone is allowed to claim trademark rights on generic dictionary-words matching my IDN.coms.

Up to this point I blame ICANN, but if Verisign does not offer a secondary sunrise clearly they are to blame.

850,000 IDNs at $8 per domain, per year.

With renewal fees for 14 years

That's 850,000 X 8 X 14

Comes out to over $95,000,000

Absolutely, Trademark law specifically excludes generics from registration, so the registration is bogus, therefore the listing in Clearing House flawed, and the Registration illegal.

Verisign know that failure that this would severely impact there reputation.

However, in ICANN's case it can only enhance it......

Not all generics are excluded. Apple, for example.

Actually might have got that a bit wrong. Too much on mind at moment.

You cannot register a Generic as a Trademark for what it describes.

Trademark Clearing House is basically there to protect big business, but actually may provide a good service to those trying to Game the system. In fact knowing the way ICANN runs that job, that is probalby now the primary purpose.

TMCH list is probably fairly useless as it changes with time.

The TMCH list is confidential by design; the Trademark/IP lobby insisted it be kept private to prevent competitors from guessing branding strategy. Of course, each registry is given access to the TMCH during the corresponding Sunrise period, but I don't know whether they are given the full list, or whether they have to send a query to the TMCH for each Sunrise domain that is registered.

Last year DomainIncite reported that an incomplete list was accidentally leaked (see http://domainincite.com/16123-full-tmch-database-published-by-registry), but the list has since been taken offline. And as RD mentioned, names are continuously being added to the TMCH.

It's easy enough to check the TM databases of most countries using a search query, but of course not every TM would be listed on the TMCH, which I understand has to be submitted by the TM holder. So that's a shame.

The Verisign newGTLD's have been in controlled interruption for 52 days now. 38 more to go.

So somewhere around October 28th is when we should see some movement.
